Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SenamGoplatform and related services (the "Service") provided by SenamGo Logistics LLC (doing business as SenamGo), available at www.senamgo.com.

By creating an account, accepting an invitation, or using the Service, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree, you must not access or use the Service.

SenamGois a technology platform that connects customers who need to ship goods — typically diaspora shipments from the United States and Europe to destinations in Africa — with independent shipping organizations ("Shippers") that fulfill pickup, transport, and delivery. SenamGo provides software for order management, tracking, payments, subscriptions, printable operational statements, and related logistics workflows.

SenamGo is not a carrier, freight forwarder, customs broker, or insurer. Shippers are independent businesses responsible for their own operations, compliance, insurance, and performance. Any contract for carriage exists between the customer and the Shipper, not with SenamGo, except for platform fees and subscriptions described herein.

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. Customer accounts may be created through self-registration. Shipper and staff accounts are generally provisioned by invitation from SenamGo or an authorized organization administrator.

You may not use the Service if you are barred under applicable law or if we have previously suspended or terminated your account for violations of these Terms.

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@senamgo.com if you suspect unauthorized access.

You agree to provide accurate, current, and complete registration information and to update it as needed. We may suspend or terminate accounts that contain false or misleading information.

Customers may create shipment orders, make payments, track packages, file disputes, and communicate with Shippers through the Service.

Shippers (shipping organizations) manage orders, containers, routes, pricing, staff, and customer relationships subject to an active platform subscription and applicable plan limits.

Staff act on behalf of a Shipper with permissions assigned by the organization.

Administrators manage platform configuration, organizations, and compliance on behalf of SenamGo.

Customers are responsible for accurate shipment details, including addresses, item descriptions, declared values, and any customs or regulatory information. Shippers are responsible for accepting or rejecting orders, safe handling, transit, delivery, and compliance with applicable transportation, import/export, and safety laws.

Estimated delivery times, rates, and service levels are provided by Shippers or calculated through platform tools and are not guaranteed by SenamGo. Risk of loss for goods during carriage is governed by the agreement between the customer and Shipper and applicable law, not these Terms alone.

Tracking information is provided for convenience. SenamGo does not warrant that tracking data will be uninterrupted or error-free.

Order payments may be processed through Stripe, including Stripe Connect for Shipper payout accounts. By submitting payment information, you authorize us and our payment processors to charge applicable amounts for orders, platform fees, taxes, and related charges.

Prices, shipping rates, item fees, and invoices are set by Shippers or platform administrators unless otherwise stated. All fees are non-refundable except as required by law or expressly stated in a refund policy communicated at checkout.

You are responsible for any taxes, duties, or customs fees associated with your shipments unless explicitly included in a quoted price.

Shippers must maintain an active subscription (or approved pay-per-use plan) to access platform features, subject to plan limits on orders, containers, routes, staff, and record retention. Subscription fees, billing cycles, trials, and cancellations are disclosed at signup and in the shipper account portal.

Failure to pay subscription fees may result in suspension of shipper features. SenamGo may change subscription plans and pricing with notice; continued use after a price change constitutes acceptance where permitted by law.

You agree not to:

• Violate any applicable law or regulation
• Ship prohibited, dangerous, illegal, or restricted goods
• Misrepresent shipment contents, value, or parties
• Interfere with or disrupt the Service or its security
• Access accounts or data without authorization
• Scrape, reverse engineer, or copy the Service except as permitted by law
• Use the Service for fraudulent or abusive purposes
• Circumvent plan limits, fees, or access controls

We may investigate violations and cooperate with law enforcement. Shippers must maintain appropriate licenses, permits, and insurance for their operations.

You retain ownership of content you submit (such as addresses, item details, and messages). You grant SenamGo a worldwide, non-exclusive license to use, store, display, and process that content solely to operate and improve the Service.

You represent that you have all rights necessary to submit content and that it does not infringe third-party rights or violate law.

The Service integrates with third parties including Stripe, email and SMS providers, and cloud infrastructure. Your use of those services may be subject to their terms and privacy policies. SenamGo is not responsible for third-party services outside our reasonable control.

The Service, including software, branding, documentation, and design, is owned by SenamGo or its licensors and protected by intellectual property laws. Except for the limited right to use the Service as permitted here, no license is granted. You may not useSenamGo trademarks without prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SenamGo DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT SHIPMENTS WILL BE DELIVERED ON TIME OR WITHOUT LOSS OR DAMAGE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SenamGo, SenamGo Logistics LLC, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO SenamGo FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless SenamGo, SenamGo Logistics LLC, and their affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your shipments, your violation of these Terms, or your violation of any law or third-party rights.

These Terms are governed by the laws of Commonwealth of Virginia, United States, without regard to conflict-of-law principles, except where mandatory consumer protections in your country of residence apply.

Before filing a claim, you agree to contact us at legal@senamgo.com to attempt informal resolution. Except where prohibited, disputes will be resolved in the state or federal courts located in Commonwealth of Virginia, United States, and you consent to personal jurisdiction in those courts.

Shipment disputes between customers and Shippers should be addressed through the platform's dispute tools and the underlying carriage arrangement between those parties.

You may stop using the Service at any time. Customers with no open shipments (orders in pending through arrived) may delete their account from Profile → Delete account. Profile information is removed; shipment and payment records are retained as described in the Privacy Policy. Shipper, staff, and administrator accounts are closed through support. We may suspend or terminate your access immediately for violation of these Terms, non-payment, legal requirements, or risk to the platform or other users.

Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including payment obligations, disclaimers, limitations of liability, and indemnity) will survive.

We may modify these Terms at any time. We will post updated Terms on this page and update the effective date. Material changes may be notified by email or in-app notice. Continued use after the effective date constitutes acceptance unless applicable law requires otherwise.
